You Have Been Served a Subpoena - Now What

What is a Subpoena?

You likely have heard the term subpoena before, but you may not know exactly what one is. A subpoena is a type of written document that requires a person to provide documents or statements that pertain to a certain case. A lot of people panic when they receive a subpoena, while others ignore them in hopes they will go away. Do not panic, but do not ignore it either.

If you receive a subpoena, let us show you the next steps you should take.

What to Do

Ignoring a subpoena can lead to bigger issues for yourself. You could end up forfeiting your rights or incurring large fines. In most cases, you have seven to 14 days to respond to a written subpoena before consequences can be taken against you. It is better to respond right away to get the ball rolling.

Call a lawyer right away if you receive a subpoena in the mail. Your lawyer can help you understand the terms of the subpoena. He or she will guide you on the best ways to disclose any confidential or sensitive information that the subpoena is asking for. Remember, you should only discuss the details of the subpoena with your attorney.

Your subpoena may ask for a lot of documents. If this is the case, an attorney will be able to help you understand just what the court wants from you. They will break it down in terms that make more sense, so do not worry if the wording is confusing to you. Your attorney is there to answer any questions you may have about the process.

Remember, never ignore a subpoena when it arrives. That can lead to more trouble you do not need. Contact your attorney as soon as possible instead. We do not recommend going to trial without legal representation.
